President Barack Obama just took a major step that will help advance the freedom to marry in very important ways. On the recommendation of the Attorney General, the President has determined that sexual orientation discrimination should be presumed unconstitutional. As a result, the Department of Justice will no longer defend the discriminatory so-called “Defense of Marriage Act” law in federal courts.

Thank you for accepting the recommendation of the Attorney General and determining that sexual orientation discrimination be presumed unconstitutional. The result of this decision means that the Department of Justice will no longer defend the discriminatory so-called “Defense of Marriage Act” law in federal courts. This is excellent news.
The Defense of Marriage Act could not be less appropriately named. DOMA actually hurts marriage by excluding committed same-sex couples and their families from it, while discriminating against couples and their families in important federal marriage protections such as the ability to sponsor a partner for citizenship, to receive Social Security spousal benefits, and to jointly file federal taxes, among many others.
