New York – Two same-sex couples filed a lawsuit in New Mexico today after being denied marriage licenses in the state, claiming that neither the marriage statutes nor the state constitution bars same-sex couples from marrying. The couples are represented by the American Civil Liberties Union (ACLU), the ACLU of New Mexico, the National Center for Lesbian Rights, and local law firms.

Santa Fe Mayor David Coss and Councilor Patti Bushee announced yesterday that they are sponsoring a resolution recognizing that marriage for same-sex couples is legal in New Mexico and urging county clerks to begin issuing licenses to gay and lesbian couples. The resolution is based on the gender-neutral language of the state marriage law and the mandate of equality in the state constitution. It also tells couples how to file suit if they are denied marriage licenses.

New York -- A poll released by ABC News today shows record support for the freedom to marry, with 58% of American voters in favor of allowing same-sex couples to legally marry, and only 36% opposed. Moreover, 64% of Americans say the freedom to marry should be decided nationwide under the Constitution, not patchwork state by state, with only 33% opposed.
