Why same-sex ruling is not ‘judicial activism’

The “separate but equal” law that led to the California Supreme Court's ruling arose because, instead of just providing marriage itself, the state contorted its laws to create a marriage-like status with a distinctly non-marriage-like name. Think about it. How often do we see legislators clamoring to create new bureaucracies to duplicate existing ones? (Link)
